CHRONOLOGY OF EVENTS: SBMA SALARY ADJUSTMENT

·         JANUARY 14, 1999           - MALACANANG APPROVED THE REQUEST OF THEN CHAIRMAN PAYUMO AND GAVE THE AUTHORITY TO THE SBMA BOARD OF DIRECTORS TO ADOPT A COMPENSATION AND BENEFIT SCHEME AT PAR WITH THAT OF BCDA CONSIDERING BOTH ENTITIES PERFORMS SIMILAR FUNCTIONS.

·         SEPTEMBER 1, 2000         SBMA IMPLEMENTED SALARY ADJUSTMENT BASED ON THE 1999 BCDA RATES

·         JUNE 2007       SBMA REQUESTED THE OFFICE OF THE PRESIDENT TO AUTHORIZE THE SBMA BOARD TO EFFECT THE CHANGES IN SALARY SCALE IN ORDER TO MAKE THE COMPENSATION AND BENEFIT SCHEME OF SBMA AT PAR WITH THAT OF THE BCDA. (NOT GRANTED)

·         19TH SEPTEMBER 2008    - SBMA BOARD OF DIRECTORS ISSUED RESOLUTION NO. 08-580 APPROVING THE PROPOSED SALARY ADJUSTMENT FOR EMPLOYEES WITH SALARY GRADE 24 AND BELOW BASED ON BCDA 2005 SALARY RATES. (GRANTED)

·         JULY 3, 2011        SBMA BOARD OF DIRECTORS APPROVED THE ADOPTION OF SALARY 2009BCDA RATES IN THREE TRANCHES. THE 1ST TRANCHE AMOUNTING TO 10% ACROSS THE BOARD BEGINNING JULY 2011. THE SUCCEEDING TWO TRANCHES SHOULD BE SUBJECT TO FURTHER REVIEW OF THE BOARDS FINANCE & EXECUTIVE COMMITTEES. (NOT IMPLEMENTED )

o   1ST TRANCHE 10% OF EXISTING BASIC SALARY OR PHP 1,000 EFFECTIVE JULY 2011
o   2ND TRANCHE 10% OF EXISTING BASIC SALARY OR PHP 1,000 EFFECTIVE JAN 2012
o   3RD TRANCHE FULL IMPLEMENTATION OF 2009 BCDA SALARY RATES EFFECTIVE JULY 2012

·         JULY 7, 2011  SBMA WRITES THE OFFICE OF THE PRESIDENT FOR THE GRANT OF 10% SALARY INCREASE FOR SBMA EMPLOYEES. (NOT GRANTED/NOT IMPLEMENTED )

·         DECEMBER 5, 2011 SBMA WRITES AN URGENT FOLLOW-UP LETTER TO THE REQUEST DATED JULY 7, 2011 APPEALING FOR FAVORABLE ACTION BEFORE YEAR ENDS TO HON. FLORENCIO ABAD JR. , DBM SECRETARY.

·         JUNE 26, 2013    SBMA WROTE A LETTER TO HON. ARNEL PACIANO CASSANOVA, PRES. & CEO OF BCDA REQUESTING FOR INFORMATION REGARDING BCDA’S LATEST SALARY SCALE AS BASIS FOR SBMA SALARY INCREASE.

·         JULY 8, 2014                        - SBMA EMPLOYEES ASSOCIATION (SEA) WRITE TO THE HON. SEN. ANTONIO TRILLANES IV ASKING FOR HELP TO IMPLEMENT SALARY STANDARDIZATION LAW (SSL III TRANCHE 4 ) TO SBMA EMPLOYEES. SEA ARGUES THAT THE LAW APPLIES TO ALL AND SSL  IS THE STANDARD SALARY RATES FOR ALL GOVERNMENT EMPLOYEES.

·         10 JULY 2014 – SBMA EMPLOYEES ASSOCIATION WAS DULY REGISTERED AS A PUBLIC SECTOR UNION OF SBMA PER CSC AND DOLE-BLR CERTIFICATION (NO.1936).

·         11 JULY 2014 CHAIRMAN ROBERTO V. GARCIA WRITES THE OFFICE OF THE PRESIDENT TO ENDORSE THE URGENT APPEAL OF SBMA EMPLOYEES FOR THE GRANT OF SALARY INCREASE.

·         10 SEPTEMBER 2014 – OFFICE OF THE CABINET SECRETARY, DEPT OF FINANCE, DBM, GOVERNANCE COMMISSION FOR GOCC’S  ISSUE A JOINT MEMORANDUM ENDORSING THE PROPOSED 10% SALARY INCREASE OF SBMA TO THE OFFICE OF THE PRESIDENT FOR CONSIDERATION AND APPROVAL.

·         24 SEPTEMBER 2014 – SBMA LEGAL DEPT. ISSUES A LEGAL OPINION STATING NO LEGAL IMPEDIMENT FOR SBMA TO IMPLEMENT THE SALARY STANDARDIZATION LAW (SSL)

·         9 DECEMBER 2014 – SBMA LEGAL DEPARTMENT ISSUES A LEGAL OPINION ON THE IMPLEMENTATION OF THE SALARY STANDARDIZATION RATE ADJUSTMENT STATING THAT THE FUNDS FOR SALARY ADJUSTMENT OF SBMA SHALL COME FROM ITS ANNUAL BUDGET SUBJECT TO DBM’S APPROVAL ON THE BASIS OF EXISTING EO AND DBM CIRCULARS AND “WITH THE DBM’S APPROVAL OF SBMA CORPORATE OPERATING BUDGET FOR CY 2015. WHICH INCLUDES THEREIN SBMA’S SALARY ADJUSTMENT, THE LATTER CAN IMMEDIATELY IMPLEMENT THE SAME”.

·         11 DECEMBER 2014 – SBMA WRITES THE OFFICE OF THE GOVERNMENT CORPORATE COUNSEL (OGCC) SEEKING CLARIFICATION WHETHER THE OPINION OF SBMA LEGAL DEPARTMENT WHICH STATES THAT RECENT ISSUANCES AND EXECUTIVE ORDER. WARRANTS SBMA TO ADJUST THE SALARIES OF ITS EMPLOYEES TO BE AT PAR AT LEAST THE SSL SUBJECT TO APPROVED BUDGET ALLOCATION.

·         14 JANUARY 2015 – SBMA BOARD OF DIRECTORS ISSUES RESOLUTION#14-12-5276 (CERTIFICATION#14-328) APPROVING THE IMPLEMENTATION OF THE MODIFIED SALARY SCHEDULE FOR CIVILIAN PERSONNEL PROVIDED IN THE SENATE AND HOUSE OF REPRESENTATIVES JOINT RESOLUTION NO. 4 S. 2009 IN THE SBMA, OTHERWISE KNOWN AS SALARY STANDARDIZATION LAW STATING THE FACT THAT “ESSENTIALLY, THE SSL SERVES AS THE MINIMUM SALARY LEVEL FOR ALL GOVERNMENT EMPLOYEES- A MINIMUM WHICH SBMA, TO THE PREJUDICE OF ITS PERSONNEL DOES NOT MEET. THE SBMA BOARD APPROVES THE IMPLEMENTATION OF SSL –RETROACTIVELY BASED ON THE FOLLOWING:

o   23 JUNE 2010     SSL 3 TRANCHE 2 – N.B.C. NO. 524, S. 2010
o   29 APRIL 2011    SSL3 TRANCHE 3 – E.O. NO. 40 S. 2011
o   11 MAY 2011      SSL3 TRANCHE 3  - N.B.C. NO. 530 S. 2011
o   30 APRIL 2012    SSL3 TRANCHE 4  - E.O. NO. 76 S.2012

·         *NOT IMPLEMENTED -THE SBMA-MANAGEMENT INSIST THAT APPROVAL OF THE PRESIDENT IS NEEDED FOR THEM TO IMPLEMENT THE SALARY ADJUSTMENT.

·         19 JANUARY 2015 – SBMA EMPLOYEE ASSOCIATION OFFICERS MEETS WITH SBMA MANAGEMENT & CHAIRMAN GARCIA TO DISCUSS THE LONG OVERDUE SBMA EMPLOYEES SALARY ADJUSTMENT. NO DEFINITE ACTIONS DURING THE NEGOTIATION WAS REACHED BY BOTH PARTIES.

·         22 JANUARY 2015 - OFFICE OF THE GOVERNMENT CORPORATE COUNSEL (OGCC) WRITES AN OPINION STATING THAT SBMA MAY NOT EFFECT AN ADJUSTMENT IN ITS EXISTING SALARY RATES WITHOUT FIRST SECURING THE APPROVAL OF THE PRESIDENT OR UNTIL THE INDEX OF OCCUPATIONAL SERVICES POSITION TITLES AND SALARY GRADES OF THE COMPENSATION & POSITION CLASSIFICATION SYSTEM UNDER RA 10149 IS APPROVED BY THE PRESIDENT, DESPITE THE FACT THAT SBMA IS EXCLUDED FROM THE COVERAGE OF RA NO. 10149 OR THE GCG LAW.

·         28 JANUARY 2015 – SEA UNION OFFICERS WRITES THE OFFICE OF THE PRESIDENT THRU THE OFFICE OF SEN. GRACE POE SEEKING FOR HER INTERVENTION TO HELP SBMA EMPLOYEES FOR THE APPROVAL OF THE SALARY STANDARDIZATION LAW (SSL III-tranche 4) AS SBMA COMPENSATION PLAN.

·         29 JANUARY 2015 – SBMA BOARD OF DIRECTORS SPLITS ITS DECISION FAVORING THE IMPLEMENTATION OF SBMA BOARD RESOLUTION. #14-12-5276 W/ CERTIFICATION#14-328, BE IMPLEMENTED BASED ON JOINT RESOLUTION NO. 4S. 2009 WITHOUT PRESIDENT APPROVAL. (NOT IMPLEMENTED)

·         9 FEBRUARY  2015 – (7:30 AM) SBMA EMPLOYEES STARTED THEIR SILENT PROTEST THROUGH WEARING OF ARM BAND DURING THEIR FLAG CEREMONY

·         12 FEBRUARY 2015 –(12:00PM TO 1:00 PM) NOISE BARRAGE HELD BY SBMA EMPLOYEES AT BLDG 229 WATERFRONT ROAD SBFZ(DURING SBMA BOD MEETING)


·         9-13 FEBRUARY 2015       (5:00PM -7:00PM) DAILY PRAYER VIGIL INFRONT OF BLDG 229( SBMA MAIN ADMINISTRATION BUILDING)  The purpose of the mass action are meant to press Chairman RVG and President Pnoy to abandon the FIRST REQUEST(10% Increase since 2011) IN FAVOR OF SSL > Since SBMA has no own Salary Scheme and SSL is the  DEFAULT PAY SCALE OR MINIMUM WAGE APPLICABLE FOR ALL GOVERNMENT.
·         16 FEBRUARY 2015- Daily Vigil was discontinue - SEA RECEIVED THE COPY OF Endorsement letter of Sen. Grace Poe to PRES. BENIGNO S. AQUINO III, ENDORSING SEA’s clamor for implementation of SSL.

·         17 FEBRUARY 2015
4:15 P,M. Chairman Garcia Called SEA President Mr. Ted Penaflor saying that he have an scheduled meeting with Pres. Pnoy on February 18, 2015 (1:00PM).

·         20 FEBRUARY 2015-A Memorandum from the executive secretary approving the 10% increase (a long overdue salary increase request last JULY 7, 2011) instead of the SSL was approved.

·         12 MARCH 2015-SBMA Employee Association (SEA) wrote a letter to Hon. Florencio B. Abad requesting to approve the submitted SBMA Corporate Operating Budget (COB) for CY2015 in which one of the items in said budget that SBMA asks to be approved is the Personnel Services (PS) where the implementation of the Salary Standardization Law SSLIII Tranche 4 AS THE COMPENSATION SCHEME for the SBMA is included.

·         3 November 2015- Chairman Roberto V. Garcia wrote a letter to H.E. BENIGNO SIMEON C. AQUINO III. Requesting that the SBMA be, at the very minimum be given authority, to increase salaries to be at par with all other agencies at SSL level  

·         13 November 2015

-                          SEA conducted a General Assembly and has decided to go to Congress and Senate to have a Silent rally (Date to be determined upon securing of clearance to LGU of Manila)
